Commission Terms and Conditions - YoyoSab

Please read these terms carefully before considering or purchasing an art commission. It is important to note that formal documentation is not required for these terms to take effect.
These terms of service are subject to change at the discretion of YoyoSab and will be updated accordingly. Commission Process

Prior to working on the commission, both the client and the artist will discuss the details of the piece, including poses, references, and further details. For commissions involving complex details (eg. detailed armour or backgrounds), additional fees will be charged. These fees will be communicated with the client before work on the commission has started. Please note that the artist has the right to decline a commission for any reason.While the artist is working on the commission, the client will receive updates for the following stages:
1. Roughs/Mockups - Sometimes referred to as “thumbnails.” Some commissions may have more roughs than others, depending on different variables. Clients may choose the direction they prefer.
2. Line-art/Sketch Cleanup
3. Base colour
4. Rendering and final detailsOne revision may be made for each stage as long as they only affect the current stage. Small adjustments may be made to previous stages, but substantial changes (eg. changing the pose at the base colour stage) will result in additional fees, which will be communicated to the client before the revision is made.The final product, which will be delivered to the client upon payment in full, will include a high-resolution .png file as well as a .jpg file. The commissioned piece will include the artist's signature where applicable.

Payment

When commissioning through Ko-Fi: Additional fees that may arise during work on the commission (such as revision fees) are to be paid once the commission is finished, and before the final product is sent to the client. These payments are to be made through Ko-Fi or through PayPal.For commissions outside of Ko-Fi: The cost of the set fees (eg. illustration fees, complex detail fees) but excluding additional fees (eg. revision fees) are agreed upon before the artist starts working on the commission. A payment of 50% of this fee is required before the artist begins working on the commission. The remaining 50%, as well as additional fees, are to be paid once the piece is finished, and before the final product is sent to the client. These payments are to be made through Ko-Fi or through PayPal.Refusal to pay any or all of the fees in full will result in the final artwork being withheld from the client until the fees have been paid.Payment is due within 30 days of delivery of the final artwork.

Refunds and Cancellations

A cancellation is possible as long as it is communicated clearly with the artist.• Canceling up to 24 hours after receiving the roughs/mockups (Stage 1 of the commission) results in a full refund with no additional fees.
• Between stages 2-3, only a partial refund (50% of the full price) is possible if that payment has already been made.
• Cancellation is not possible at the final stage of the drawing (Stage 4).In the event that the artist is unable to complete the commission, for reasons beyond their control and not due to client intervention, a full refund will be issued to the client. However, if any of the terms and conditions are breached by the client, the artist has the right to stop work on the commission with no possible refunds.

Ownership and Usage Rights

Upon completion of the commissioned artwork, all legal ownership and copyright of the artwork remain the exclusive property of YoyoSab. This means you, the client, do not have the right to claim or redistribute the artwork as your own.
You are granted a non-exclusive, non-transferable license to use the commissioned artwork for personal use only. This includes displaying the artwork in your personal collection, using it as profile pictures or wallpapers, and sharing it on your personal social media accounts, provided proper credit is given to YoyoSab as the artist.

Prohibited Actions

You may not sell, license, reproduce, distribute, or otherwise commercially exploit the commissioned artwork without explicit written consent from YoyoSab.
You may not modify or alter the commissioned artwork in any way, including but not limited to: cropping, adding filters, or making derivative works, without prior written permission.Under no circumstances should the artwork be used for AI (Artificial Intelligence) software, especially AI generators, whether for training purposes or any other application. If commissioned artwork from any stage of the commission process (including roughs/mockups) is used in AI software, the client automatically agrees to purchase the artwork as a Full Buyout (All Rights), and accepts any and all additional or adjusted fees that may occur as a result.

Crediting the Artist

When sharing the commissioned artwork on social media or any public platform, you are required to provide proper credit to YoyoSab as the artist. This should include the artist's name and a link/tag to the artist's website or social media profile. (eg. Artwork by @yoyo.sab/Art by YoyoSab @yoyo.sab/Emotes by yoyo_sab)

Privacy and Data

Any personal information shared during the commission process will be kept confidential and used solely for the purpose of completing the commission. YoyoSab (the artist), will not share or sell your information to third parties.
